A high-stakes murder case involving the death of Kasipul MP Charles Were took a shocking turn on Wednesday, as the main suspect, Ebel Ochieng Kalo, allegedly issued death threats against a State Prosecutor during court proceedings.


Kalo, a board member of the Lake Basin Development Authority (LBDA) and a prominent official within the United Democratic Alliance (UDA), stands accused of orchestrating the brutal assassination of the MP. The chilling incident unfolded at the Milimani Law Courts, where Kalo appeared before Justice Diana Kavedza.
Threats in the Courtroom
The courtroom was left in shock when Kalo reportedly threatened Allen Mulama, an officer with the Office of the Director of Public Prosecutions (ODPP). The prosecution disclosed that the suspect made brazen remarks against Mulama after the prosecutor opposed Kalo’s release on bond.
“One of the accused persons, Ebel Ochieng, has threatened to kill the ODPP officer, forcing the State Counsel to excuse himself from court,” the prosecution informed the judge.
The threat prompted Justice Kavedza to immediately order heightened security measures within the courtroom, emphasizing the severity of the situation.
Court Denies Bond and Orders Mental Assessment
In her ruling, Justice Kavedza denied bond for Kalo and his co-accused, citing concerns about the safety of witnesses and judicial officers.
“The accused person’s utterance of ‘huyu tutamuua’ raises significant concerns. If such threats are made against a prosecutor, what about the witnesses? Bond is hereby denied,” the judge ruled.
Kalo was directed to undergo a mental assessment at Mathari Hospital. Meanwhile, he and his co-accused will remain in custody at Nairobi Remand Prison, with one suspect being placed in isolation pending further evaluations.
Additional Suspects Ordered to Undergo Assessment
In a parallel session, Justice Margaret Muigai ordered mental assessments for two additional suspects, Isaack Kuria and Allan Omondi Ogolla. Both individuals are linked to the case and will remain detained at Kamiti Maximum Security Prison as investigations continue.
The court also ensured the provision of legal representation for the suspects as the prosecution considers potential plea agreements.
Assassination Details
The late MP Charles Were was fatally shot on April 30, 2025, in a targeted attack at the City Mortuary roundabout on Ngong Road, Nairobi. Police reports indicate that a gunman dismounted from a motorcycle at a traffic stop and fired multiple rounds at the MP before fleeing the scene.
Among those implicated in the crime are the MP’s bodyguard, Allan Omondi, and his driver, Walter Owino. Authorities allege they were part of a larger criminal syndicate involved in the assassination.

The case is set for a mention on June 17, with investigations ongoing. The prosecution vowed to pursue the matter rigorously, urging the court to maintain a firm stance on ensuring justice.
