The six judges who were never appointed by former President Uhuru Kenyatta in 2021 will receive Ksh.126 million in compensation.

Judges Joel Ngugi, George Odunga, Aggrey Muchelule, Weldon Korir, Judith Omange, and Magistrate Evans Makori moved to court, citing violation of their rights as a result of delayed appointment.

The court awarded the judges Ksh.15 million each as damages and Ksh.5 million as exemplary damages. The ruling explained that Uhuru ought to have appointed judges within a reasonable time.

In the words of the presiding judge, “The delay in appointing these judges is an outright breach of their rights.” Further, he said, “They deserved reasons in writing from the president for his inactions.”

The President swore six of the judges into office in 2022 after the ruling. Ruto said he supported judicial independence, adding: “We have to ensure justice is served without delay.”

He called for timely appointment for continued public confidence in the courts. The judges said they were grateful about the ruling of the court. “This ruling restores our faith in the justice system,” said Judge Ngugi.
