Businessman Jimi Wanjigi has been released on a personal bond of Ksh.10 million after being arrested and detained at Kamukunji Police Station on Monday.

The businessman appeared in court on Tuesday, where he was ordered to surrender his passport pending a ruling scheduled for September 12 on whether he will enter a plea.

Wanjigi and the second suspect will find out on the same date whether or not the charges against them will be dismissed on September 12th, this year.

Earlie on Tuesday, Wanjigi’s lawyers asked the court to postpone the plea. Senior Counsel Paul Muite claimed that a prior court barred the police from arresting Wanjigi.

He further stated that the order also instructed the police to release Wanjigi if he had already been detained.

The lawyers also claimed that, in response to allegations of illegal firearm possession, the police acted maliciously and in contempt of court by cancelling Wanjigi’s firearm license, which had been reinstated by the High Court.

Lawyer Wallis Otieno further noted that the Firearm Licensing Board revoked Wanjigi’s license, which had been restored, in order to charge him with illegal firearm possession.

Lawyer Otieno also contended before Presiding Magistrate Susan Shitubi that the charges against Wanjigi were fundamentally flawed, as the police had violated court orders by arresting him.

He added that Wanjigi was detained after voluntarily responding to police summons to appear before DCI officers.

Otieno however claimed that the second accused, Kibe, was subjected to physical abuse by squeezing his genitals while in custody.
