Kibwezi MP with Cs Mutua before National Assembly Meeting
Kibwezi West MP Mwengi Mutuse moved a motion in Parliament to remove Deputy President Rigathi Gachagua from office for breach of the Constitution and misconduct.
A total of 291 Members of Parliament have signed the motion. Speaker Moses Wetang’ula says all the 11 grounds are substantively supported and meet the threshold as provided for in the Constitution.
Mutuse opened charges against Gachagua on Tuesday, accusing him of offenses under Kenyan law, international law, and the Constitution.
“The Constitution of the Republic of Kenya is not a mere document. The Constitution speaks to the soul of this nation,” Mutuse said.
He accused Gachagua of violating several articles of the Constitution, including Articles 6(2), 10(2)(a), and 174. He also pointed out the violations of Article 3(1) and Article 148(5)(a).
Mutuse backed his claims with affidavits, documents and videos. “I will demonstrate through videos, affidavits and documents how Gachagua has breached the law that he swore to protect.”
He also accused Gachagua of illegal amassing of wealth. In two years, Gachagua’s property grew from Sh800 million to over Sh5.2 billion.
“He earns slightly over Sh1 million monthly, so in two years, he could justly accumulate about Sh24 million,” argued Mutuse. He labeled the rest of the assets as “unexplained.”
Mutuse further accused Gachagua of violating the Proceeds of Crime and Anti-Money Laundering Act, the Penal Code, and the Leadership and Integrity Act. Further, he described Gachagua as disrespecting public officials and the office he holds.
“I do not have any grudge, malice, or ill will against Gachagua. I am only just trying to play my role as a citizen and fulfilling my mandate,” said Mutuse.
MPs seconding the impeachment motion include Eric Mwangi Mathira, Kimani Ichung’wah Majority leader, Junet Mohamed Minority leader, Otiende Amollo, Millie Odhiambo among others. Parliament will later debate the motion after the Speaker has certified the same.on.
