A dramatic scene unfolded outside Wang’uru Law Courts in Mwea, Kirinyaga, when Jacqueline Christy Akinyi, a key interested party in a Ksh.30 million fraud case, publicly demanded the arrest of Issadin Gabane Mohamed, a suspect who has failed to appear in court for plea taking over the last two years.

Akinyi’s frustration stems from the prolonged delay in the case, where Mohamed was to be charged with intent to defraud, having allegedly obtained Ksh.30 million by falsely pretending to supply 6,000 bags of sugar. Despite the charge sheet being processed and stamped on August 23, 2022, the suspect has not been presented in court, prompting the court to issue an arrest warrant that has yet to be executed.

Accusations of Police Interference

Akinyi claimed that although the investigating officers traced Mohamed to Nairobi, their efforts to arrest him were thwarted after receiving threats of dismissal from the Directorate of Criminal Investigation (DCI) headquarters. She accused senior DCI officers of protecting the suspect and preventing his prosecution.

In court, the prosecutor sought an adjournment, citing an order from the Kerugoya High Court halting the case proceedings until the high court determines its direction. Meanwhile, the accused’s lawyer claimed his client was still ill, but the magistrate questioned why the investigating officer assigned to verify the suspect’s health was not present in court.

Adjournment and Further Delays

Principal Magistrate Faith Mutuku adjourned the case to February 19 for further directions, awaiting outcomes from the ongoing high court proceedings in Kerugoya. Outside the court, Akinyi expressed her frustration after attending hearings for two years, hoping the suspect would finally face justice. She voiced concerns that the delay might prevent her from ever receiving justice.

Akinyi has now called on DCI Director Mohamed Amin to intervene and ensure that his officers stop interfering with the case, allowing the suspect to face the full force of the law.
